Privacy Policy

This Privacy Policy explains how Platinumedge Technologies Ltd ("PlatinumEdge," "we," "us") collects, uses, discloses, and protects personal information in connection with platinum-edge.ca and our Services.

1. Scope & roles

We act as a controller/organization for most processing and may act as a processor for certain partner-directed activities. This Policy applies to visitors, applicants, customers, and business contacts.

2. Legal framework

We comply with applicable privacy laws, including PIPEDA (Canada) and, where relevant, Quebec Law 25, GDPR (EU/UK) for users in those regions, and CPRA/CCPA (California) for California residents. Our marketing practices comply with CASL.

3. Personal information we collect

  • Identity & KYC: name, date of birth, government-issued ID data, selfie/biometrics (if used), address, occupation, source of funds/source of wealth details.
  • Contact: email, phone, mailing address.
  • Financial & transactional: payment instrument metadata, funding/withdrawal details, transfers, counterparties, amounts, timestamps.
  • Risk/compliance: sanctions/PEP screening results, adverse media flags, device/IP data for fraud and AML monitoring.
  • Technical: device IDs, IP address, browser, OS, cookie IDs, logs, analytics, approximate location.
  • Communications: support requests, recordings (where permitted), marketing preferences.
  • Recruitment: CV/resume data (if applicable).

We collect data directly from you, from your device, and from service providers/partners (e.g., KYC/AML vendors, payments, analytics).

4. Purposes & legal bases

We use information to:

  • Provide Services and customer support; perform contracts.
  • Comply with law (AML/ATF, recordkeeping, reporting to FINTRAC where required).
  • Detect & prevent fraud/abuse; security monitoring.
  • Improve & analyze Services; personalize content; measure performance.
  • Communicate service notices and marketing (with consent per CASL).
  • Recruit candidates (if you apply).

Legal bases (GDPR): contract, legal obligation (e.g., AML/ATF), legitimate interests (security, product improvement), and consent (where required - e.g., marketing, certain cookies).

5. AML/ATF & regulatory disclosures

As an MSB, we may need to verify identity, monitor activity, and file certain reports (e.g., suspicious transaction reports) with FINTRAC and retain records as required by law. We may be legally restricted from notifying you about certain reports.

6. Sharing

We share personal information with:

  • Service providers/processors: KYC/AML vendors, fraud prevention, cloud/hosting, analytics, communications, and payments partners;
  • Financial institutions involved in providing Services;
  • Corporate affiliates;
  • Authorities: law enforcement/regulators (e.g., FINTRAC) as required or permitted by law;
  • Business transfers: in a merger, acquisition, or financing.

We require recipients to implement appropriate safeguards and process data only as instructed or permitted by law.

7. International transfers

We may transfer data outside your province or country (e.g., to the U.S. or EU). Where required, we implement safeguards (e.g., contractual clauses and risk assessments).

8. Retention

We keep information for as long as needed to provide Services, meet legal/AML obligations, resolve disputes, and enforce agreements - then securely delete or anonymize it. (AML laws may require extended retention.)

9. Your rights

Depending on your location, you may have rights to access, correct, delete, port, restrict/opt out, withdraw consent, and object to certain processing.

  • Canada (PIPEDA): access and correction; meaningful consent; breach notification rights. Contact us or the Office of the Privacy Commissioner of Canada (OPC) for guidance or to file a complaint.
  • Quebec (Law 25): additional rights including data portability, transparency around automated decision-making, and appointment of a privacy officer. Complaints may be filed with CAI Quebec.
  • EU/UK (GDPR): rights under Arts. 12-22; you may contact your supervisory authority.
  • California (CPRA/CCPA): rights to know, delete, correct, limit use of sensitive PI, and opt out of sale/sharing and certain profiling.

10. Marketing & CASL

We send commercial electronic messages only with consent or as permitted by CASL. You can unsubscribe via email footer or account settings. We maintain consent records.

11. Cookies & tracking

We use cookies, analytics, and tracking technologies to improve your experience, analyze usage, and personalize content. You can manage cookie preferences through your browser settings.

12. Children

Our Services are not directed to children under 18 years old. Do not provide personal information for minors without lawful authority.

13. Security

We implement administrative, technical, and physical safeguards appropriate to the sensitivity of information (access controls, encryption in transit, monitoring, vendor due diligence). No system is 100% secure.

14. Changes

We may update this Policy. Material changes will be notified via the Services or email where appropriate.
