Who we are
These Terms of Use ("Terms") govern your access to and use of the website platinum-edge.ca and any related apps, products, and services (the "Services") provided by Platinumedge Technologies Ltd (doing business as PlatinumEdge Technologies), 5455 152 St. office 237, Surrey, BC, support@platinum-edge.ca ("PlatinumEdge," "we," "us," "our").
Regulatory status
PlatinumEdge provides financial technology services and operates as a Money Services Business (MSB) in Canada. FINTRAC MSB Reg. No.: C100000579. We are not a bank, do not take deposits, and Services are not CDIC-insured. We may provide Services via regulated third-party financial institutions and service providers.
1. Acceptance
By accessing or using the Services, you agree to these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Services.
2. Eligibility & account
- You must be at least 18 and capable of forming a binding contract.
- You agree to provide accurate information and keep it current.
- We may require identity verification (KYC) and ongoing monitoring to comply with anti-money laundering and anti-terrorist financing (AML/ATF) laws, including screening against sanctions/PEP lists and reporting certain transactions to FINTRAC. You consent to our collection, use, disclosure, and retention of information for these purposes.
- We may refuse, suspend, or terminate accounts for risk, fraud, or non-compliance.
3. Permitted use & prohibited activities
You may use the Services only for lawful purposes and in accordance with these Terms. Prohibited activities include:
- Illegal transactions, fraud, money laundering, terrorist financing, sanctions evasion, or use in prohibited jurisdictions
- Abusing promotional programs; attempting to circumvent security; scraping, reverse engineering, or introducing malware
- Infringing intellectual property or privacy rights
- Using the Services for high-risk or illegal virtual asset activity (if applicable) or unlicensed payment services
We may monitor, freeze, or reverse transactions, and we may report suspicious activity to authorities as required by law.
4. Third-party services
Some features rely on third parties (e.g., banks, payment processors, KYC vendors, cloud providers). Their terms and privacy practices apply in addition to ours. We are not responsible for third-party content or delays outside our control.
5. Fees & taxes
We may charge fees disclosed in the interface or in a separate fee schedule. You are responsible for applicable taxes and charges.
6. Electronic communications & e-sign
You agree to receive electronic disclosures/records and to transact electronically. Paper copies and withdrawal of consent procedures are described in our E-Sign Consent.
7. Intellectual property
All content, trademarks, logos, and software are owned by us or our licensors and are protected by IP laws. You receive a limited, revocable, non-transferable license to use the Services for personal or internal business purposes.
8. Privacy & marketing
Our processing of personal information is described in the Privacy Policy. Marketing communications comply with CASL; you can unsubscribe anytime.
9. Risk disclosures
Financial services involve risks (e.g., service interruptions, partner bank outages, FX/fiat price volatility if applicable, regulatory changes). We do not guarantee uninterrupted access. If your use involves virtual assets, values can fluctuate and legal/regulatory treatment can change.
10. Disclaimers; limitation of liability
The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties (express or implied). We are not liable for indirect, incidental, special, consequential, or punitive damages, or any lost profits, data, or goodwill, even if advised of the possibility. Our total liability will not exceed the greater of CAD $100 or the amount you paid for the Services in the 3 months before the claim. Some provinces do not allow certain limitations; your rights may vary.
11. Indemnity
You agree to defend, indemnify, and hold us and our affiliates, partners, officers, directors, employees, and agents harmless from claims, damages, losses, and costs (including legal fees) arising from your use of the Services or violation of these Terms or applicable law.
12. Suspension & termination
We may suspend or terminate access at any time for any reason, including risk, suspected fraud, or legal requirement. You may close your account according to our support process. Sections that by their nature should survive (e.g., IP, disclaimers, liability limits, indemnity) will survive.
13. Governing law & disputes
These Terms are governed by the laws of British Columbia and Canada, without regard to conflicts of law. Courts located in Vancouver, British Columbia will have exclusive jurisdiction. For Quebec consumers, mandatory arbitration and certain limitations may not apply where prohibited by law.
14. Changes
We may update these Terms from time to time. The "Last updated" date shows the latest version. Continued use indicates acceptance.
